Recovery agent threats, abuse, family ko call — yeh sab illegal hai. Yeh hai RBI ke under tumhare exact rights aur action kaise lo.

Pehle relax karo. Tum criminal nahi ho.

Loan default = civil matter, not criminal. No agent, no police, no one can arrest tumhe just for missed EMIs (small loans, no fraud). Agar koi yeh dhamki de raha hai, woh already break the law.

  1. Call before 8 AM or after 7 PM. Period.
  2. Call your contacts, family, employer, neighbours. Only YOU can be contacted.
  3. Use abusive language, threats, casteist slurs. Criminal offence under IPC + IT Act.
  4. Threaten arrest, FIR, jail. Loan default is civil — no police involvement.
  5. Visit your home without 7-day prior written notice.
  6. Publicly shame you — WhatsApp groups, Facebook, "wanted" posters.
  7. Misuse your phone contacts/photos that the app accessed.
  8. Pretend to be police, lawyer, or court official.
  9. Threaten or abuse women / elderly family members.

Tumhare 6 active rights

1. Right to identify the agent

Demand the agent's name, employee ID, the lender's authorisation letter. No proof = hang up, woh fake hai.

2. Right to record

In India, recording a call you are part of is legal (consent of one party is enough). Record everything. It's your evidence.

3. Right to written communication only

Tell them in writing: "Henceforth, communicate only via email/post." Repeated calls after this is harassment.

4. Right to grievance redressal

Every lender must have a grievance officer. Their email/phone must be on the app and the loan agreement.

5. Right to escalate to RBI

If the lender doesn't respond in 30 days, file at RBI Sachet.

6. Right to dignity (DPDP Act 2023)

Any non-consensual sharing of your data, photos, contacts = violation. ₹250 cr fine on the lender + criminal liability.

Step-by-step: agar abhi kuch ho raha hai

  1. Don't pick up unknown numbers. Let them go to voicemail/SMS.
  2. Do pick up calls from registered numbers — but record + stay calm.
  3. Send a written cease-and-desist within 24 hours (sample below).
  4. File at Sachet within 7 days of harassment incident.
  5. If physical threat / family contacted → 112 (police) immediately + cyber crime cell (cybercrime.gov.in).

Sample cease-and-desist (paste this)

I am the borrower of the above account. Your recovery agents have [briefly: called family / used abusive language / called outside permitted hours] on [date(s)]. This violates RBI Fair Practices Code §6 and the Digital Lending Guidelines 2022.

I am willing to discuss repayment in writing only. Cease all calls to me, my contacts, family, and employer. Any continued harassment will be reported to RBI Sachet and the Cyber Crime cell.

Recordings/screenshots are preserved. Please confirm receipt within 48 hours.
