Background — yeh rules kyun aaye?
2020-21 mein loan-app harassment, fake recovery agents, aur insane interest rates ki wajah se 200+ suicide cases report hue. RBI ne September 2022 mein Digital Lending Guidelines (DLG) notify kiye. Ab har regulated lender (banks, NBFCs aur unke apps) ko in rules ko follow karna hai — non-compliance par license cancel ho sakta hai.
Tumhare 8 core rights
1. Key Fact Statement (KFS) — loan disburse hone se pehle
Lender ko KFS dena hai jo dikhaye: total amount, APR (annualized), fees ka breakdown, EMI schedule, recovery mechanism. No KFS = no loan. Agar tumhe sirf "monthly rate" dikha aur APR nahi, complaint file karo.
2. Cooling-off period
Tumhe loan cancel karne ka right hai (usually 3 din ke andar) sirf principal + proportionate APR pay karke. Processing fee bhi refund honi chahiye.
3. No "tip" or hidden fee
App tumse "tip" / "donation" / "processing fast-track" nahi maang sakti. Sab kuch APR mein included hona chahiye.
4. Disbursement direct to your bank account
Loan paisa lender ke account se directly tumhare bank account mein aana chahiye — kisi third-party wallet ya pool account ke through nahi.
5. Repayment direct to lender
EMI bhi tumhare bank se directly lender ko jaani chahiye. Agar koi "agent" tumse cash maange — that's a violation.
6. Data privacy — only what's needed
App sirf woh data access kar sakti hai jo loan ke liye genuinely required hai (KYC, income proof, bank statement). Contacts, gallery, location maangna ban hai.
7. Grievance Redressal Officer (GRO)
Har lender ka ek named GRO hona chahiye, contact details app + KFS mein visible. 30 din mein response na mile to RBI Ombudsman (cms.rbi.org.in) jaa sakte ho.
8. No coercive recovery
Threats, abuse, contact-list shaming, fake legal notices — sab Fair Practices Code violations hain. Recovery agent rights padho.
Agar lender rules todh raha hai
- Screenshot + screen recording le lo (proof first).
- App ke andar GRO ko complaint, written reply maango.
- 30 din mein resolve nahi hua → RBI CMS par complaint, plus Sachet portal par bhi file karo.
- Local police mein FIR if harassment is criminal (extortion, blackmail).
Bottom line
